Police: Huron-Kinloss driver refuses to provide breath sample, charged

HOWICK TOWNSHIP – Huron County OPP have charged a Huron-Kinloss resident with impaired driving offences and resisting a peace officer following an interaction with police on July 17.

In a media release, police say an officer was patrolling on Amberley Road in Howick Township when they located a parked vehicle.

“The driver appeared to be sleeping, and the officer was able to eventually get the driver’s attention,” states the July 20 release.

Police say the driver refused to exit the vehicle or identify themselves.

“Evidence of alcohol consumption was observed within the vehicle,” states the release.

Additional officers responded to assist, according to police, and the driver was removed from the vehicle.

“The investigating officer determined that the driver had consumed alcohol prior to driving and was subsequently arrested for impaired operation,” say police.

The driver was taken to the OPP detachment in Clinton, where police say the accused refused to provide breath samples and resisted officers during the process.

The accused, a 38-year-old Huron-Kinloss resident, has been charged with operation while impaired, failure or refusal to comply with demand, and resist a peace officer. They were also charged with offences found in the Highway Traffic Act and Liquor Licence Control Act.

The accused was released from custody with a court appearance scheduled for Aug. 28 in Goderich.
